Acceptance & scope
These Terms of Service ("Terms") are between you ("User") and PixVPS ("we" or the "Platform") and apply to all services you access, register for, or use through pixvps.com and its subdomains.
Any of the following constitutes full understanding and acceptance of these Terms:
- Checking agree on registration, sign-in, or checkout pages, or clicking Confirm, Continue, or similar buttons;
- Accessing, browsing, or using any platform features or services in any manner;
- Completing registration and successfully creating a rental order.
If you disagree with any part, stop accessing and using immediately. Services are for natural persons or organizations with full legal capacity—individuals under 18 may not register or use the service.
Services you receive
PixVPS provides cloud server rental on dedicated Apple Silicon Mac mini M4 hardware, including:
- Dedicated physical Mac mini M4 rental (daily / weekly / monthly / quarterly billing; Singapore, Japan (Tokyo), South Korea (Seoul), Hong Kong, US East)
- SSH command-line and VNC graphical desktop access (including browser VNC)
- 1 Gbps dedicated bandwidth and dedicated public IPv4
- Optional SSD storage expansion and Thunderbolt 5 multi-Mac clustering
- OpenClaw sandbox isolation, zero-trust access control, and operation audit
- Console management, ticket-based technical support, and related operations
You agree we may adjust, upgrade, or retire features as needed. Service form, available regions, and feature list follow what the platform shows at the time; reasonable changes do not constitute breach or liability.
Account registration & security
Information accuracy
You must provide true, accurate, complete, and up-to-date registration information. You bear all consequences of false, outdated, or incomplete information. Each user may generally hold only one platform account unless we agree otherwise in writing.
Credential custody
You are responsible for safeguarding account passwords, email verification codes, SSH keys, VNC passwords, and other credentials. Actions under your account are deemed yours or authorized by you, and you bear corresponding legal liability. Notify us immediately via ticket if you detect abnormal login or suspected theft; we are not liable for actions before notification.
No lending or sharing
Without our written permission, you may not transfer, lend, share, or allow third parties to use your account, order rights, or server access. Violations may result in immediate suspension or termination without refund.
Payment & renewal rules
Pricing & prepayment
After you confirm a billing cycle (daily / weekly / monthly / quarterly), the order period generally cannot be shortened to a shorter cycle. Unless required by law or explicitly promised in writing, paid fees are non-refundable.
Auto-renewal
Weekly, monthly, and quarterly subscriptions auto-renew by default. You may disable auto-renewal in the dashboard before the current cycle ends; service stops when the cycle expires. Daily rental is one-time payment with no auto-renewal.
Price adjustments
We reserve the right to adjust pricing. Changes do not affect your current paid cycle; new prices apply from the next billing cycle.
Payment methods & taxes
We currently support USDT-TRC20 and Stripe cards (Visa / Mastercard / American Express) as shown at checkout. Listed prices exclude taxes that may apply in your jurisdiction; you bear related tax obligations.
Compliant use & prohibited conduct
You agree to use PixVPS services only for lawful purposes and comply with applicable laws and these Terms. We may immediately suspend accounts without refund upon discovery of:
To protect the platform and other users, we may reasonably monitor account activity. For suspected violations, we may suspend service without prior notice and investigate; fees during investigation still accrue per normal billing rules.
Availability targets & maintenance
Availability commitment
We strive for stable, reliable service with a target monthly availability of 99.9% (excluding planned maintenance and force majeure). This target reflects our operational commitment and is not an independently enforceable SLA compensation promise; specific remedies follow published SLA or ticket outcomes.
Planned maintenance
We will try to announce planned maintenance via email or dashboard notice; for urgent security or infrastructure work, we may act without prior notice. Unavailability during maintenance is excluded from availability statistics.
Reasonable resource use
Each device has defined CPU, 16 GB unified memory, storage, and bandwidth specs. If your usage unreasonably impacts shared network facilities or other users, we may limit resource use or temporarily suspend features to maintain overall stability.
Data custody & user responsibility
You are responsible for backing up and migrating important data. PixVPS does not provide default full automatic backups and is not liable for data loss, damage, or irrecoverability due to:
- Hardware failure, accidental damage, or data-center incidents
- Data wipe after service expiry, account suspension, or order termination
- User error, software defects, or third-party application issues
- Natural disasters, war, epidemics, or other force majeure
After order expiry or termination, server data will be securely erased within 72 hours and cannot be recovered. Export and migrate data before service stops.
Regularly sync critical code, build artifacts, and business data to independent external storage or other cloud services—do not use PixVPS nodes as your only data store. See the Privacy Policy for personal data rules.
Intellectual property
PixVPS platform UI, branding, documentation, software code, API design, and operational materials are owned by PixVPS or respective rights holders and protected by applicable IP law. Do not copy, modify, distribute, or create derivative works without written authorization.
Rights to content you store, run, or generate on rented devices are as agreed between you and relevant rights holders; you grant us a limited, non-exclusive license necessary to transmit, store, and operate such content to fulfill the service.
You also agree we may use anonymized, aggregated statistics and performance data that cannot identify individuals to improve platform stability and product experience.
Disclaimers & liability caps
To the maximum extent permitted by law, PixVPS makes no express or implied warranties regarding the service, including merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for service interruption, data loss, or other harm caused by:
- Internet backbone, carrier links, or upstream network provider failures
- Natural disasters, war, government controls, epidemics, or other force majeure
- Failures or policy changes by payment processors, email providers, or other partners
- Hacking, malicious intrusion, or other unauthorized third-party acts
- Losses from your misconfiguration, misuse, or software compatibility issues
- Third-party claims or regulatory action from content you store or transmit
- Measures required to comply with law, courts, or regulators
Cumulative liability cap
In any case, PixVPS's total cumulative liability to you for these Terms or related services shall not exceed service fees you actually paid to us for the disputed matter in the most recent calendar month before it arose.
We are not liable for indirect, incidental, special, punitive, profit, business opportunity, goodwill, data value, business interruption, or third-party contract breach damages, whether or not advised of possibility. Some jurisdictions do not allow exclusion or limitation of certain damages; this clause applies only to the maximum extent permitted.
Suspension, termination & return
User-initiated termination
You may disable auto-renewal anytime in the dashboard to stop future charges. Service ends when the current paid cycle expires; paid fees are non-refundable.
Platform termination rights
We may immediately suspend or permanently terminate service without prior notice and without refund if any of the following occurs:
- Violation of any prohibited conduct in the acceptable use section
- Fees overdue more than 72 hours without payment
- Suspected fraud or clearly illegal use of the account
- Requirements of law or lawful orders from competent authorities
- Your conduct materially impacts platform infrastructure or other users
Data cleanup
After termination, we will delete server data linked to the order within 72 hours. This is irreversible secure erasure—complete backups beforehand.
Terms revisions
We may revise these Terms from time to time. Updated versions will be posted on this page with a revised effective date. Continued use after publication means you accept the updated Terms.
If you disagree with revisions, stop using the service and disable auto-renewal before they take effect. Your current paid cycle not yet expired generally remains under prior Terms unless law or we state otherwise.
Dispute resolution & governing law
Negotiation first
For disputes arising from these Terms or related services, both parties shall first negotiate in good faith. Contact us via dashboard ticket or email; we will respond within a reasonable period.
Governing law & jurisdiction
Formation, validity, interpretation, and performance of these Terms are governed by the laws of the People's Republic of China (excluding conflict-of-law rules). If negotiation fails, either party may bring suit in a court with jurisdiction where the platform operator is located.
Severability
If any provision is held invalid or unenforceable, it shall be narrowed or replaced as necessary; remaining provisions remain in full effect.
